Préambule :

Les présentes Conditions Générales de Vente régissent les relations entre la SAS AD Objects,  dont le siège social est situé au 9 Grande Rue, 26170 Mollans-sur-Ouvèze, immatriculée à la chambre des métiers et de l'artisanat de Romans sous le numéro 904 132 099 et ayant pour enseigne commercial le nom « Monnette Paris » (ci-après « Monnette») et tout consommateur souhaitant effectuer un achat sur le site internet www.monnette.fr  (ci-après « le CLIENT »).

MONNETTE vend des couverts anciens personnalisés gravé à la main, sous la marque déposée MONNETTE . Toutes les créations en vente sur la boutique en ligne sont protégées par dépôt d'huissier.

MONNETTE se réserve le droit d'adapter ou de modifier les présentes Conditions Générales de Vente. En cas de modification, seront appliquées à chaque commande les conditions en vigueur au jour de la commande.

Commande

Toute commande implique l'acceptation pleine et entière des présentes Conditions Générales de Vente. En commandant sur le site internet, le CLIENT déclare et garantit à MONNETTE qu’il est majeur et a la capacité juridique pour contracter.

Les modalités de commande sont détaillées sur le site internet.

Toute commande ne sera prise en considération que si elle est complète et après acceptation du paiement. Le CLIENT qui aurait une commande incomplète rendant impossible l’exécution de sa commande et/ou son exécution se verra contacter par mail ou par les réseaux sociaux en messagerie privée. Sans réponse de sa part dans les 30 jours, sa commande ne pourra pas être traitée et fera l’objet d’un remboursement.

Le CLIENT est et reste pleinement responsable des données communiquées lors de sa commande, que ce soit les éléments de personnalisation des articles, ses données personnelles et d’expédition et en conséquence des erreurs qu’il pourrait commettre dans sa commande et des préjudices qui pourraient en découler.

MONNETTE s’engage à honorer les commandes reçues dans la limite des stocks disponibles et en cas d'indisponibilité à en informer le client par tout moyen à sa convenance ; le client pourra alors annuler sa commande et se faire rembourser, le cas échéant, les sommes déjà versées.

Droits de douane

Toute commande passée sur le Site et livrée en dehors de la France pourra être soumise à des taxes éventuelles et à des droits de douane qui sont imposés lorsque le colis parvient à sa destination. Ces droits de douane et ces taxes éventuels liés à la livraison d'un Produit sont à la charge du CLIENT et relèvent de sa responsabilité. MONNETTE n’est pas tenu de vérifier et d’informer le CLIENT des droits de douane et taxes applicables. Pour les connaître, MONNETTE conseille au CLIENT de se renseigner auprès des autorités compétentes de son pays.

Price

Les prix sont exprimés en Euros.

MONNETTE se réserve le droit de les modifier en cas d’augmentation des charges, notamment du taux de TVA, et en cas d’erreur manifeste.

Le CLIENT doit également s’acquitter, en plus du prix des articles commandés, d’une participation forfaitaire aux frais d’envois et de traitement de la commande dont le montant lui est indiqué avant la validation définitive de la commande.

Payment terms

MONNETTE retains ownership of the items until full payment of the price by the customer.

Purchases are made securely. The payment solutions adopted by the site www.monnette.fr are 100% secure. For payments by bank card (credit card, visa credit card and e-credit card), a banking organization is responsible for securing the payments.

These solutions help protect the information that customers communicate and guarantee the compliance and security of each transaction.

All texts, photos, brands, illustrations and images and more generally all elements likely to be protected by intellectual property law reproduced on the site;www.monnette.fr are the property of MONNETTE and are protected by intellectual property throughout the world. Any total or partial reproduction is strictly prohibited without prior written authorization from MONNETTE.

Right to retract

The essential characteristics of the articles are presented on the site www.monnette.fr  in each of the item sheets. The CUSTOMER is fully informed that, given the limitations of the internet, the images, photos and colors of the jewelry may not strictly correspond to the actual colors.

In accordance with the provisions of article L.121-21-828 of the Consumer Code, the right of withdrawal provided for in the event of distance selling cannot be exercised for contracts for the supply of goods made according to the consumer's specifications or clearly  personalized or which, due to their nature, cannot be returned or are likely to deteriorate or expire quickly.

Consequently, the CUSTOMER is informed that the right of withdrawal is not applicable to sales of personalized items from the MONNETTE company.

However, in the event that MONNETTE has made an error in the execution of the order, MONNETTE undertakes to remake the item according to the CUSTOMER's request provided that the latter has communicated this by email to:hello@monnette.fr within 4 days from delivery of your order and returns the jewelry to the MANNETTE address.

MONNETTE will then send the CUSTOMER a new item at its own expense.

 

Item defect

In accordance with the regulations in force, MANNETTE undertakes to respect its legal obligations relating to the guarantees attached to the articles sold on the website and which appear in articles L.211217-4 to L.211217-13 of the Consumer Code and the articles 1641 to 1648 and 2232 of the Civil Code.

If the apparent defect, lack of conformity or even the hidden defect of the item, declared by the CUSTOMER, if applicable, is proven, after an assessment has been carried out, MONNETTE may proceed to replace the item. If this is not possible, MONNETTE will reserve the right to reimburse the CUSTOMER at their own expense.

It is specified that the guarantees do not apply to normal wear and tear of certain parts, nor in the event of use for a purpose other than that for which the items are designed, nor to damage caused by external causes.

In the event of non-compliance of the item(s), the costs of reshipping by the CUSTOMER to MONNETTE are then free or reimbursed.

Consumer Code

The seller is required to deliver goods in conformity with the contract and is liable for any lack of conformity existing at the time of delivery.

He is also liable for defects in conformity resulting from the packaging, assembly instructions or installation when this has been his responsibility by the contract or has been carried out under his responsibility.

To comply with the contract, the property must:

1° Be suitable for the use usually expected of similar goods and, where applicable:

- correspond to the description given by the seller and possess the qualities that the seller presented to the buyer in the form of a sample or model;

- present the qualities that a buyer can legitimately expect having regard to the public declarations made by the seller, by the producer or by his representative, in particular in advertising or labeling;

2° Or present the characteristics defined by mutual agreement by the parties or be suitable for any special use sought by the buyer, brought to the attention of the seller and which the latter has accepted.

The action resulting from the lack of conformity is prescribed two years from the delivery of the goods.

The CUSTOMER is exempt from providing proof of the existence of the lack of conformity of the goods during the twenty-four months following delivery of the goods.

The CUSTOMER may decide to implement the guarantee against hidden defects in the item sold within the meaning of article 1641 of the Civil Code. In this case, he can choose between canceling the sale or reducing the sale price in accordance with article 1644 of the Civil Code.

Civil Code:

The seller is bound by the guarantee for hidden defects in the item sold which make it unfit for the use for which it is intended, or which reduce this use to such an extent that the buyer would not have acquired it, or would not have used it. would have given a lower price, if he had known them.

 

Action resulting from redhibitory defects must be brought by the purchaser within two years from the discovery of the defect.

Données nominatives et communication

During visits to the site www.monnette.fr the CUSTOMER is required to provide information about himself through forms, and in particular when creating a customer account.
This information is intended for MONNETTE responsible for processing, for the purposes of recording and processing orders, and managing customer accounts.
In accordance with the law of January 6, 1978, the customer has a right of access to personal data concerning him which he can exercise in writing with MONNETTE 

Cookies

When consulting the Site, information relating to navigation may be recorded in files called "Cookies" installed on the CUSTOMER's terminal (computer, tablet, Smartphone, etc.).

These Cookies are issued by MONNETTE or by third-party partners with the aim of facilitating the CUSTOMER's navigation on the website by allowing, for example, more quickly to display pages that the CUSTOMER has already consulted, avoiding him having to communicate his identifiers again , or collect and store information relating to the CUSTOMER's navigation on the website in order to provide them with personalized services
